Welcome to Fouji Adda. These Terms & Conditions (“Terms”) govern your access to and use of the Fouji Adda website, Android app, and iOS app (collectively, the “Platform”), operated by Fouji Adda Tech Private Limited(“Fouji Adda,” “we,” “us,” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

2. Scope of These Terms

These Terms apply to your use of:

• Fouji Adda website

• Fouji Adda Android app

• Fouji Adda iOS app

These Terms apply only to the above digital platforms. Any separate offline, assisted, or manually handled process outside the Platform may be governed by separate terms, documents, or communications shared during that process.

3. About the Platform

Fouji Adda is an informational, discovery, and lead-generation platform. The Platform may provide users with access to information, tools, content, comparisons, dealer-related details, enquiry forms, and other features related to vehicles, loans, guest houses, and other services.

Fouji Adda aims to make information more accessible and useful to users. However, use of the Platform does not create any guarantee, commitment, or obligation for any transaction unless separately agreed in writing through a different process.

4. Eligibility to Use the Platform

By using the Platform, you confirm that:

• you are legally capable of entering into a valid and binding arrangement under applicable law;

• the information provided by you is true, accurate, and not misleading to the best of your knowledge;

• you will use the Platform only for lawful purposes.

If you are using the Platform on behalf of another person or entity, you confirm that you are authorized to do so.

5. Account Registration and Access

Users may create or access their Fouji Adda account using their mobile number and OTP verification.

You are responsible for maintaining the confidentiality and security of your account access and for any activity carried out through your account or verified mobile number. If you believe your account has been accessed without authorization, you should contact us promptly.

6. Use of the Platform

You may use the Platform only for genuine personal or lawful business enquiry purposes and in accordance with these Terms.

You agree not to:

• misuse or interfere with the Platform or its normal functioning;

• attempt unauthorized access to any account, server, database, or system connected to the Platform;

• copy, reproduce, scrape, republish, or exploit Platform content in bulk without written permission;

• submit false, misleading, fraudulent, or unlawful information;

• impersonate any person or entity;

• use the Platform in any way that may damage, disable, overburden, or impair our services;

• use the Platform for abusive, harmful, defamatory, or illegal activity.

We reserve the right to restrict or suspend access where we reasonably believe misuse, fraud, abuse, or policy violation has occurred.

7. Enquiries and User Consent

By filling out any enquiry form or submitting your details on Fouji Adda, you agree that Fouji Adda may use those details to respond to your enquiry and help connect you with relevant service providers, dealers, or related business parties, where applicable.

Submission of an enquiry does not mean that any booking, sale, approval, eligibility, delivery, or transaction has been confirmed.

8. Communication Permission

By using the Platform and submitting your information, you agree that Fouji Adda may contact you, where relevant, through:

• phone calls

• WhatsApp messages

• SMS, including OTP-related communication

• email, if provided by you

• push notifications, if enabled on your device

Such communication may relate to enquiries, updates, offers, information, support, news, or platform-related announcements. Promotional communication may also be sent where applicable, subject to any opt-out options available under applicable law or platform controls.

9. Third-Party Dealers, Partners, and Services

The Platform may display or refer users to third-party dealers, service providers, advertisers, partners, or external services.

Fouji Adda may help users discover, compare, or connect with such third parties. However:

• the final decision to engage with any dealer, partner, or third party is entirely yours;

• any pricing, offer, delivery timeline, product detail, service quality, availability, approval, or promise made by a third party is the responsibility of that third party;

• Fouji Adda is not a party to any independent arrangement, promise, or dispute between you and a third party unless expressly stated otherwise in a separate written arrangement.

Users are advised to independently verify important details before making any decision.

10. Information and Content Disclaimer

The information available on Fouji Adda is intended for general informational and convenience purposes. While we try to keep the Platform useful and reasonably updated, some information may change over time.

This includes, for example:

• vehicle prices

• specifications

• offers

• dealer details

• eligibility information

• comparison content

• articles and guides

• guest house information

• tool outputs and estimates

Such information may vary by city, state, dealer, time, product updates, or third-party policy changes. Users should independently confirm any important detail before relying on it for a financial, purchase, travel, or service decision.

11. No Direct Online Sale Through the Platform

Fouji Adda does not currently sell vehicles, loans, insurance products, or other services directly through the website or app, and no payment gateway is integrated on the Platform for such online transactions.

Submitting an enquiry through the Platform does not create a contract for sale, booking, or purchase.

If any separate offline or assisted process is later handled outside the Platform by Fouji Adda, such process may be governed by separate terms, forms, or agreements shared at that time.

12. User Content, Suggestions, and Feedback

If you submit feedback, suggestions, ideas, reviews, or other content to Fouji Adda, you agree that we may use, review, moderate, or remove such content in accordance with our business and operational requirements.

You should not submit any content that is false, unlawful, abusive, defamatory, infringing, misleading, or harmful.

Fouji Adda reserves the right, but not the obligation, to remove, refuse, or moderate content that it reasonably believes violates these Terms or may create legal, reputational, or operational risk.

13. Intellectual Property

All content on the Platform, including but not limited to text, graphics, design, layout, branding, logos, interface elements, tools, images, compilations, software elements, and other materials, is owned by or licensed to Fouji Adda unless otherwise stated.

You may not copy, reproduce, modify, distribute, publish, display, sell, or exploit any part of the Platform without prior written permission from Fouji Adda, except for normal personal use of the Platform for its intended purpose.

14. Platform Availability and Updates

We may update, improve, modify, suspend, or discontinue any part of the Platform or any feature at any time, with or without notice.

We do our best to keep the Platform functioning smoothly, but we do not guarantee that the Platform will always be available, uninterrupted, error-free, or free from delays, bugs, or technical issues.

15. Account Suspension or Termination

Fouji Adda may suspend, restrict, or terminate access to the Platform or a user account if we reasonably believe that:

• these Terms have been violated;

• false or misleading information has been submitted;

• the Platform is being misused;

• fraudulent, abusive, or unlawful activity is suspected;

• suspension is necessary for legal, operational, or security reasons.

Users may stop using the Platform at any time. Account deletion, where available, will be handled in accordance with the Privacy Policy and the applicable platform process.

16. Third-Party Links

The Platform may contain links to third-party websites, pages, advertisements, or services for user convenience.

Once you leave the Fouji Adda Platform and access a third-party service, your use of that service will be governed by its own terms and privacy policy. Fouji Adda is not responsible for the content, policies, or practices of third-party platforms.

17. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis.

While we aim to provide a useful and reliable experience, Fouji Adda does not guarantee that:

• the Platform will always be available without interruption;

• all content will always be complete, current, or error-free;

• all information shown by or through third parties will always remain accurate;

• the Platform will meet every individual requirement or expectation.

Use of the Platform is at your own discretion and risk.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Fouji Adda shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage arising out of or in connection with:

• your use of or inability to use the Platform;

• reliance on information available on the Platform;

• any act, omission, promise, service failure, delay, dispute, or conduct of any third-party dealer, advertiser, or service provider;

• technical issues, downtime, data loss, unauthorized access, or system interruption beyond reasonable control.

Nothing in these Terms excludes liability where such exclusion is not permitted under applicable law.

19. Privacy

Your use of the Platform is also subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Platform, you also agree to the applicable Privacy Policy.

20. Changes to These Terms

We may revise these Terms from time to time to reflect platform changes, legal requirements, or operational updates.

The revised version will be posted on the Platform with an updated effective date. Your continued use of Fouji Adda after such revision will be treated as acceptance of the updated Terms.

21. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi.
